Description: On 9/6/2006, i responded 372 karen dr. and observed the rear yard was strewn with rubbish, several large vehicle tires were observed stacked alongside the stand alone garage/workshed. i attempted to make contact with the resident but no one answered the door. a card was left at the door and a warning sticker was placed on the mailbox. a warning notice was mailed to the owner, mr. kimbrell troy on 9/6/2006 via fedex and registered usps mail. on 9/6/2006 at approximately 4:00pm, i received a phone call from mr. troy indicating he would attempt to clean up the rubbish and garbage from his rear yard. mr. troy would not give a time when he would be able to complete this action. on 09/13/2006, i re-inspected the residence and it was found to be in compliance.

Description: 03/14/2007 - received call from compliant that his neighbor at 1021 colony dr. had several dogs and that smell from the dogs was coming into his yard. he asked that i check for any code violations. i went to the address and noted the sounds of 2 or more barking dogs as i approached. the backyard of 1021 colony dr. had a privacy fence so i did not see the dogs. from the barking activity i estimated 2 to 4 dogs were on the property. i did not note any offensive smells and i did not note any dog droppings in the portion of the yard that was visible. from my observations i determined that there did not appear to be a code violation. 04/03/2007 - received message from city hall that someone had called to complain about the conditions at 1011 colony dr. because of dogs and dog smells at the property. i accompanied officer schroeder to 1011 colony dr. and spoke to the owner, ms mora, and observed the condition of the property. we looked at the living area of the dogs in the garage, observed the lawn for signs of dog droppings, and discussed the alpharetta city code as it relates to animals with ms mora. i did not observe any code violations at the property. i did not note any offensive smells in the yard. office schroeder and i spoke to the neighbor at 1021 colony dr. and determined that he did not have a complaint at that time.

Description: 06-11-07 - received complaint about dogs and the condition of the backyard at 5070 harbour ridge dr. i visited the property and witnessed that the backyard was well shaded and bare of grass. i could not locate the owner. i did not see any dogs, but there was evidence of a dog or dogs being maintained at the location. there was no evidence of an excessive number of dogs and i did not observe evidence of a code violation. the backyard was not as well maintained as surrounding yards, but was being maintained in compliance with city codes. 10-05-07 - received a second complaint via email about dogs at this address. i visited the property again, and again i could not locate the owner. i spoke the neighbor at 115 harbour ridge run and ask if i could view the subject property from his backyard. he said yes and he later described some of the concerns the neighborhood has about the property including the trees and lack of sod. the backyard at 5070 harbour ridge dr. had a strong odor of dog excreta. i noted that the fenced area was approximately 4400 sq feet. the fence was approximately 8'9" from the house at 115 harbour ridge run. 10-08-07 - revisited the property to speak to the owner, but i could not locate her. 10-09-07 - i spoke to the owner at her property. she indicated that her relationship with her neighbors has been strained and that she is trying to sell her home so that she can move. she stated that she helps with animal rescue and has had fulton county animal control out to her home several times. she said she has worked with officer smalley in the past and that she is in compliance with fulton county animal control. i told her that i would try to contact officer smalley and speak to him. she said she had only 6 dogs on the property and no puppies. she said that she picks up the dog excreta daily and tries to keep the odor controlled with lime. fulton county animal control codes state that any enclosure used by domestic animals shall be free from accumulations of animal excrement and objectionable odors and clean and sanitary. i will contact the owner again after i speak with office smalley. 10-10-07 - i left a voicemail message requesting officer smalley to call me to discuss his investigation of 5070 harbour ridge dr. 10-11-07 - received copy of fulton county animal services report via email from ms rodgers for my review. 10-11-07 - received voice mail from officer smalley informing me of his investigation. he found no dog excrement inside the home or in the backyard. the odor he found was spoilled milk the owner had provided to the cat. 10-12-07 - returned to the property to speak to the owner. she did not answer the door. i measured the distance from the dog enclosure to the neighbors house. it was approximately 9 feet. the minimum distance per fulton county animal ordnance is 25 feet. 10-15-07 - visited the property to speak to the owner, but she did not answer. 10-17-07 - i met with the owner, ms rogers, in the front yard of her home. when i started to explain the 25 foot restriction concerning domestic animals and their proximity to a neighbors house she became emotional, almost to the point of tears, and expressed her frustration with, as she expressed, the two immediate neighbors attempts harass her by continually call the authorities about the animals in her home. (the 25 foot restriction is contained in the fulton county municipal code section 34-210) ms rogers point was that her neighbors call the authorities at the slightest provocation, even to the point of their fabrication of facts while at the same time allowing their animals (dogs) to bark and use her front yard and the island in the cul-de-sac as a toilet. she was very vocal while expressing her frustrations and attracted the attention of one of the neighbors. the neighbor from 115 harbour ridge run came out and challenged ms rogers's statements. they exchanged comments and ms rogers went inside her home. i spoke a few moments with the neighbor. he comments centered on the attitude of ms rogers and the condition of her backyard, primarily the trees in the backyard. the neighbor stated, to effect, that if ms rogers would cut her trees everything else would be ok. ms rogers has also alluded to the desire of her neighbors to have the trees removed from her backyard and on my visit of 5 october 07 i spoke to the other homeowner at 115 harbour ridge run and he stated that the neighbors have spoken to ms rogers about cutting the trees. i informed the neighbor that trees are under the jurisdiction of the city arborist. 10-17-07 - i received an email forwarded to me from officer blood, sent to him by apd officer john curry requesting any information: i have copies of two fulton county animal services reports, dated 9-18-07 and 10-08-07, of visits to 5070 harbour ridge dr. the reports indicated that there are no fulton county violations. the alpharetta police have been to 5070 harbour ridge dr. on several occasions and have not been able to take action on the complaints. i have visited the property several times. on dry, hot days i noted the unpleasant odor, on other days i did not note the odor. ms rogers states that she cleans the yard regularly and has applied lime. i observed pine straw mulch. 10-29-07 - in response to the several complaints from neighgbors i mailed a synopsis of my investigation to ms. sandra miesse. my report acknowledged that the backyard at 5070 harbour ridge dr. is not as well groomed as surrounding properties, but is not in violation of city codes. i also addressed the animal control investigations preformed by fulton county. 1-22-08 - received email requesting i revisit 5070 harbour ridge dr. i spoke to ms rodgers about the complaint of an excessive number of dogs. she stated that she expected to see me because officer smalley of fulton county animal control had been out a couple of days earlier. i left a voice mail for officer smalley asking for an up-date on his investigation. ms. rodges stated officer smalley did not note any animal control violations. i observed the exterior of 5070 harbour ridge dr. and did not note any city of alpharetta code violations. the back yard remains bare of ground cover, but i did not note any animal excrement on the ground. i did not notice any odors.

Description: 11/19/07 - received complaint from mr. crawford that his back neighbor at 252 churchill heights had cut trees and was planning to erect a fence in the designated undisturbed buffer area between their properties. i met with the homeowner of 252 churchill heights, mr. eberhardt about cutting trees and building a fence in the buffer. the trees that were removed were from the front yard, not from the buffer. i did not see any trees being removed from the buffer. he also stated he had no plans to erect a fence or other structure in the buffer. 08/29/08 - no violation. received call from bret that kathy would like for me to check this address for a violation of homeowner putting debris and erecting a fence in an undisturbed buffer at the rear of his property. the homeowner was not home, but a worker at the house gave me permission to inspect the backyard. i did not enter the backyard, but observed as much as possible from the fence. i did not see any construction or other evidence that the buffer has been disturbed. i did not see any debris in the backyard or buffer. i left my card with the worker and requested he give it to the homeowner. the work being done at the home did not require a permit. 10/23/08 - neighbor at 1810 twin flower ct, ms. theurer, complained that the neighbor at 252 churchill heights may try to erect a fence in the undisturbed buffer. spoke to mr. eberhardt at 252 churchill heights about this. he doesn't have a fence yet, but is concerned about neighbors coming on his property. i explained fences were not allowed in buffer areas. he was polite, but indicated if necessary he would involve his attorney. 10/24/08 - sent mr. eberhardt a letter via regular mail to better explain the requirements of the city's udc regarding areas designated as undisturbed buffers. 12/17/08 - re-inspected the undisturbed buffer. the buffer remains undisturbed. 06/12/09 - received an e-mail from maxine, windward cma, about a neighbor's complaint of construction material in the yard and construction at 252 churchill heights. 06/12/09 - did not see any construction material on the property or evidence of construction activity. 06/16/09 - re-inspected the property. i spoke to the homeowner. he has installed some new windows and is installing new shelving in the baby's room. windows and shelving do not require a permit. he complained of the neighbor's dogs coming into his yard and issues with the neighbors. i notified maxine. 06/18/09 - receive an e-mail from maxine, windward cma. she has spoken to mr. eberhardt also and believes the issue is resolved. 06/24/09 - responded to diana about letter from mr. eberhardt's attorney. 06/26/09 - placed diana's response to mr. eberhardt's attorney in file. 07/11/09 - received phone call from ms. lori theurer at my home stating mr. eberhardt was erecting a fence in the undisturbed buffer and that she had called the police but they were unable to stop him. i contacted diana, at her home, to report the situation and request guidance. we determined to inspect the property on 13 jul 09. 07/13/09 - officer schroeder and i inspected the undisturbed buffer from ms. theurer's backyard. the fence is installed and completed along the rear property line of 252 churchill heights. the fence follows the survey markings. i made photos of the fence. i will issue a notice of violation after speaking to diana. 07/13/09 - received a voice mail from mr. tony tyson requesting additional information about the fence in the undisturbed buffer. i returned his call and left him a voice mail stating we were investigating. 07/13/09 - received a voice mail from ms. theurer requesting additional information. i returned her call and left her a voice mail stating we were investigating. 07/14/09 - returned to ms. theurer's backyard to make additional photos of the fence. spoke to a relative of ms. theurer who was at the house to explain what i was doing. 07/14/09 - received a voice mail from ms. nancy cockerham of 242 churchill heights stating her concerns about the fence at 252 churchill heights possibly being on her property. i tried to return her call, but the number given was a fax machine. 07/14/09 - left ms. theurer a voice mail informing her of my actions so far. 07/15/09 - spoke to ms. nancy cockerham of 242 churchill heights. she requested the status of my efforts to have the fence at 252 churchill heights removed. i told her we are in the legal process and that it will be several weeks before we'll have a court date. 07/16/09 - issued a notice of violation to mr. eberhardt for violation of udc sections 2.3.6b, 1.4.2, 2.3.5a and city council v-95-04. the notice of violation requires the fence to be removed no later than 7:00 pm 23 july 09. 07/24/09 - re-inspected the fence at 252 churchill heights. the fence remains in place and has not been removed. 07/24/09 - scheduled court date to hear the case. court is scheduled for 17 september 09 at 1300. 07/27/09 - issued summons to appear before the municipal court judge to the property owner of 252 churchill heights, mr. eberhardt. 01/25/10 - this case has been moved to fulton superior court - awaiting final decision. 09/16/10 - still no information about this case. last contact with the city attorney confirmed the case was still pending. 05/04/12- received conformation fulton county superior court heard this case today and ruled in the city's favor. mr. eberhardt was ordered to remove the fence within 30 days. notified ms. theurer and ms. cockerham of the court's decision. also notified dawn and kathi to update any files they may hold. 02/04/13 - received email from city attorney indicating the motion for reconsideration in the eberhard case has been denied. city attorney states that we will wait 30 days for him to remove the fence and then send a deman if the fence has not been removed. 03/25/13 - the fence remains in place. photographed and forwarded photos to city attorney 07-01-13 - fence has been removed, after 3 years & 354 days -case closed

was notified via e-mail that the posted notice had been removed. 27 sep 12 - replaced notice of violation on the front door. 2 oct 12 - mailed a formal notice of violation with a deadline of 16 october 12 to bring the property into compliance to the owner. also attached a copy of the notice of violation to the front door. 17 oct 12- issued a summons to the homeowner for october code enforcement board. sent summons to the homeowner via fedex. also attached a copy to the front door. 25 oct 12- ceb heard case and found defendant guilty: "the property should be compliance no later november 30th, 2012 and that if it is not that a fine of #100 per day will be assessed. the motion further directs staff of the city of alpharetta to contact the department of health and ask for their assistance with an inspection at this house if they feel they have any department of health jurisdiction. having found the defendant guilty that we issue a cease and desist order, was found guilty of violating 304.1 304.2 304.6 304.7 and 304.15. that the property needs to come into compliance by november the 30, 2012 and if it doesn't a fine of 100 per day will be assessed. the motion also directs the staff of the city of alpharetta to contact the department of health to see if they will be willing to inspect the property and further directs the city to subpoena his defendant suzanne downing to the november 15th meeting of the code enforcement board" 1 nov 12 - spoke to fulton county department of health at 3155 royal dr, alpharetta about obtaining their assistance with an interior inspection of this property. i was informed that the environmental division of fulton county health did not do those types of inspections, but was directed to contact the state environmental health dept at 404-657-6534 or fulton county community of sanitation rodent infestation supervisor at 404-613-1516 for their possible assistance. 6 nov 12 - attempted to speak to the state dept of environmental, 404-657-6534, but was told the person i need to speak to, julia cambell, was out of the office for the day. 7 nov 12 - spoke to julila cambell at the state environmental health dept, healthy homes division. she suggested i contact james at fulton county health dept, healthy homes div. her office is at the state level and is responsible for the entire state excluding fulton county. 8 nov 12 - ms downing has completed the electrical repair she was directed to make by the ceb. the main cut off switch and the electric meter is properly secured to her house. she informed me via email that she is making arraignments for the other repairs. i informed her that an inspector would need to make an internal structural inspection 9 nov 12 - spoke to an associate of james at fulton county health dept, healthy homes div. at 404-763-5579. he directed me to the regional office for n. fulton county - mr. ed smith- 404-332-1801. 14 nov 12 - mr. smith works in the office that directed me to ms. cambell at the state environmental health dept. because ms. downing is making progress in the repairs the ceb has directed her to make, i will continue to monitor her progress and request an interior inspection before contacting fulton county heath again. 14 nov 12 - spoke to ms downing at her home. provided her with information about the ceb meeting, observed the garage door was being replaced, and did not note any evidence of possible health related issues. i did not enter the home, but observed through the open front door that the portion of the interior i could see appeared clean and neat. 15 nov 12 - observed and photographed the completed repairs - main electrical cutoff switch and garage door. remaining issues, roof, windows, and siding in progress. nov 12 - appeared at the ceb. ceb extended deadline until 30 jan 13 for completion of repairs. 16 jan 13 - sent an email to ms. downing requesting a status report on the remainig repair items due 31 jan 13. 23 jan 13 - sent a follow up email requesting a status report on the remaining reparirs. 24 jan 13 - received e-mail response to my e-mail requesting an updat on the remaining repairs. homeowner stated the repairs were in progress and should be underway or completed by the deadline. 4 feb 13 - reinspected the property to verify repairs had been completed. they have not. 7 feb 13 - reinspected to check the progress of the repairs. they have not been completed. i will e-mail the homeowner and request an update. 8 feb 13 - sent an email to the homeowner requesting a status report. 21 feb 13 - sent an e-mail to the homeowner requesting an update on the the progress of repairs. the deadline for completion is 3 weeks past due. did not receive a response to my e-mail. 21 mar 13 - sent an e-mail to the homeowner requesting an update on the the progress of repairs. the deadline for completion is 7 weeks past due. did not receive a response to my e-mail. 28 mar 13 - reinspected the property for completion of repairs. the roof has not been repaired. provided the ceb with an update on the status of repairs ordered by the board. provide the board with a letter to begin the process of collecting fines associated with the violations. sent an email to the homeowner informing her that the ceb will meet today and that she is invited to appear before the board to explaine any extenuating circumstances as to why she did not meet the deadline. 28 mar 13 - the code enforcement board wants to summon the homeowenr to the next ceb meeting to determine why the repairs have not been completed.

Description: 02-11-09 - vehicle with tarp parked in driveway 08-12 - officer schroeder visited the proeprty and informed the property oweners that for the vehicle to remain at the premisis they must be repaird. 10-29-12 - received complaint about vehicle with expired license plate parked in the driveway visible from the street. found two inoperative vehicles parked in the driveway. one vehicle had flat tires and a license plate expired in 2007. the second vehicle had flat tires and a license plate expired in 2009. 10-30-12 - posted formal notice of violation to the front door of the property. the deadline for bringing the property into comopliance by repairing both vehicles and properly licensing both vehicles is 7 november 2012. 11-7-12 - spoke to the homeowner. he is in the process of moving out of the state and is waiting for the relocation company to pick up the vehicles. he will move them into the garage if there is a week or more delay of having them picked up.

Description: 28 jun 10 - received complaint about rubbish and junk in the driveway. investigated and found rubbish from a fire in the driveway and rubbish, junk, & debris, in open pit the pool once was. sent a notice of violation with al 12 july deadline to bring the property into compliance. 12 jul 10 - the trash has been removed from the driveway and placed in a dumpster. the dumpster remains in the driveway. 18 jul 10 - certified letter returned to office as undeliverable. 17 aug 10 - spoke to dumpster company about the dumpster in the driveway. they reported the contractor working on the house has called for several swap outs. the dumpster in the driveway is not the original dumpster. 31 aug 10 - received request for information about the dumpster from assistant city mananger. responded that i had contacted the dumpster company, that work was going slowly, but the dumpster was legal. 1 sept 10 - received complaint about the dumpster from the neighborhood. the dummpster is used for the clean-up and can be in the driveway. 15 sept 10 - re-inspected the property. the dumpster has been emptied several times which indicates fire clean-up activity. a permit is not required for clean-up. 7 jan 11 - gave warning about work without a permit - roof & windows do not require a permit, but any construction activity does require a permit. requested the homeowner contact the building department. 13 may 11 - yellow tag warning for tall grass. 16 may 11 - re-inspected - the grass and weeds have been cut 27 july 11 - warning for grass 5 aug 11 - re-inspected - grass cut ok 10 nov 11 - issued stop work for construction without a permit. 8 mar 12 - permit issued for reconstruction due to fire damage. 28 mar 12 - received complaint from subdivision about the dumpster 13 jun 12 - received complaint from subdivision that the property does not meet subdivision standards. 23 jan 13 - tree has fallen on the fence and the side gate does not close. contacted homeowner to repair the fence because of the safety issue it has created. 2-6-13 - re-inspected, fence is not repaired 2-13-13 - re-inspected, fence has not been repaired 2-28-13 - re-inspected - ok 3 sep 13 - spoke to mr. howell about the condition of his property and that he must cut the backyard, clean up the trash and debris and maintain the property and gave a deadline of 13 sept to complete the cleanup. he stated he was out of town and would try to get someone over to take care of the issues. 4 sep 13 - issued a notice of violation for the condition of the accumulation of trash and debris and the grass and weeds, and to cover the pit/pool no later than 13 sept. 16 sep 13 - re-inspected for compliance and 80-85 percent of the issues had been resolved. will speak with him about the remaining issues.

Description: Notes from storm water enginner: from reviewing the documents and photographs and our site visit, it appears that the property owner at 310 jayne ellen way is not committing any stormwater violations. our field observation was that the low point where both of these houses would drain is between the lots at 310 and 320 jayne ellen way with the low point falling on 320. the city's gis topography backs this up. sometime in the past, it appears the homeowner at 310 flattened out part of the slope near his house to install a small garden, and used some 6-inch hdpe to continue his gutter spout around the garden beds. there is photographic evidence that this was done at least 3 years ago and the homeowner's at 310 indicated that this condition was created as prior to that. it does not appear that this condition is creating a worse drainage situation versus not having this down spout extension. the same amount of water would be directed in the same direction. there does not appear to be a violation of the city's stormwater ordinance.
