Description: 13 nov 12 - neighboring homeowner reported she is concerned about the condition of the retaining wall between her property and 420 north pine and that she feel it is in danger of collapse. 14 nov 12 - photographed retaining wall. the wall appears solid with one small section in disrepair. showed photographs to the building official and he agreed the wall does not appear in danger of collapse. ownership of the wall is in question. 16 nov 12 - spoke to neighboring homeowner (410 n. pine dr.) and explained that the wall does not appear in danger of collaspe. the damaged portion should be repaired, but probably does not affect the structural integerty of the wall at this time. i also explained the ownership dispute related to the wall. she is considering getting a survey. 28 nov 12 - spoke to the neighboring homeowner again and she had decided to get a new survey. i explained that even if the survey shows 210 north pine as owner only the damaged section would have to be repaired. the entire wall would not have to be replaced. 3 dec 12 - the neighboring homeowner phoned to say she has a new survey that it shows the wall to be on 210 north pine's side of the property line. 6 dec 12 - visit 420 n. pine, no answer at the door. 7 dec 12 - visit 420 n. pine, no answer at the door. 10 dec 12 - visit 420 n. pine, spoke to resident about the damaged wall. she claims they have a survey or plat that shows the wall to be on the property line or on the neighbor's property. i informed her i would do more research and let her know how the city would proceed. 14 dec 12 - spoke to the neighboring homeowner. she is disatisified with the progress. will send a letter to 420 n. pine homeowner. 17 dec 12 - sent letter to mr. gibson with a description of the portion of the wall to be repaired. 10 jan 13 - received voice mail from mr. gibson requesting information about the status of the retaining wall complaint. i then left him a voice mail saying i had sent him a letter in december. 16 jan 13 - sent an email to mr. gibson with the letter of 17 dec 12 attached. in addition to the letter i attached photos and the section of the cpmc that references walls. 30 jan 13 - received an email from mr. gibson with a copy of his survey attached. he requested i advise him as soon as possible how the city intends to proced in regard to this matter. i forwarded his email to my supervisor. 4 feb 13 - replied by email to ms eckart & mr. gibson that the disputed ownership of the retaining wall is a civil matter between the two property owners and that the city does not intend to proceed until the ownership question is resolved. 4 feb 13 - received email reply from both homeowners. 19 feb 13 - mr. gibson stated in his email he will complete the repairs - a six week extension from this date was granted 'it is my understanding that a six (6) week extension has been given with regard to the time period within which the repairs are to be completed. i will complete the repairs using the 6x6 pressure treated posts you advised me were acceptable. new deadline is april 2, 2013. 1 april 13 - re-inspected and photographed the wall. repairs have not been completed. issue nov on 3 april if repairs are not complete/started. 3 april 13 - issued a nov with a deadline for completion of 12 april 2013. 15 april 13 - issued a summons to the april 25 code enforcement board 24 april 13 - case was removed from the april 25 ceb while civil lawsuit related to the case is before fulton county court
