Description: The applicant has submitted a variance request seeking authorization to reconstruct a section of non-conforming wall as part of a larger residential construction project authorized under town of danville building permit #b13-008620. under #b13-008620, the property owners are extensively remodeling and enlarging the existing residence at this address. the location of the original residence resulted in minor encroachment into the required minimum side yard setback and resulted in an aggregate side yard condition slightly below the required minimum. specifically, with the location of the original residence, the existing east side yard was less than the 15' minimum side yard standard called for by the property's r-20: single family residential zoning designation and the aggregate side yard condition was less than the 35' minimum called for by r-20 standards. building permit #b13-008620 reflected the property owner's intent to preserve those portions of the existing residence that created the substandard side yard setback conditions. the original residence's eastern side yard (right side of residence as viewed from the street) had a minimum side yard setback ranging from 14.2' to 14.5' - where a 15' minimum setback was required under r-20 zoning standards. the existing western side yard (left side of residence as viewed from the street) had a minimum side yard setback ranging from 18.8' to 19.1' - where a 20.8' minimum side yard setback was required under r-20 zoning standards to provide for the required 35' minimum aggregate side yard requirement. while the construction project has successfully retained the original western side wall (allowing the property owners to retain the 18.8' to 19.1' non-conforming side yard on that side of the residence), the original eastern side wall, for a variety of reasons, was not able to be retained during construction. this variance request seeks authorization to re-establish the 14.2' to 14.5' minimum side yard condition on the eastern side of the residence with new construction (i.e., to replicate the original wall with a wall of new construction and pulling forward the historic non-conforming side yard condition). granting the variance would also serve to authorize the provision of a 33.0' aggregate side yard condition where a 35' aggregate minimum is required under r-20 standards.
