Description: The following is the information a citizen submitted using the online form on the hillsborough county code enforcement complaint form. description of complaint = dear sir / madam on march 22nd 2011, my wife linda, a property manager, received calls from concerned neighbors indicating a vacant home in foreclosure, located at: 9713 stone mountain place, tampa fl. 33634-1082, air-conditioning system was being removed. linda immediately went to the property and observed a van in the driveway displaying advertisement as american electrical services and 813-977-5991, and several unknown men removing the air conditioning unit. when linda confronted, one of the unknown men he became very hostile and threatened her, yelling obscenities and demanded she leave the property. linda immediately contacted the hillsborough county sheriff's department to report the incident, and then contacted me because the man was so hostile. i immediately traveled to the residence, and witnessed the exterior condenser, loaded on a dolly coming from the left side of the home and then loaded into the van. within several minutes, an air handler was coming out of the attic access. two deputy sheriff's arrived an talked with one of the unknown men, then talked to someone by phone, indicating it was ms janice watkins the home owner. the deputies indicated she had authorized the removal of the air conditioning system. historically, during this type work certain special equipment would be necessary and present during removal or installation a/c units, i.e. gages and hoses, recovery cylinder/tank, recovery pump, electric cords, etc.. only several hand tools observed.note, no gages where observed, necessary to pump down freon and contain in the existing unit my concerns: if this existing a/c unit was not removed correctly and freon not properly contained, this conditions results in further environmental disaster and additional depletion of worldwide depletion of our ozone layer, although this may seem small as one additional unit, it is of accumulative damage! systems must be pumped down and contained as per all federal, state and local minimum requirements. after removal of the existing air condenser, a different 10 seer condenser has been placed in the same location of the previously removed condenser. this is for display purposes only. no consideration has been given to wind load fastening to approved ballastslab, tie downs have not been installed or any other requirements to accommodate the current florida building code. the electrical terminations are not connected or protected in any manner, simply exposed conductors, which may pose lifesaety issues! no electrical terminations have been completed and bare copper conductors exposed exist, highly visibly to all children in passing. consequently, ms. watkins property adjoins both common children's play area and the direct entrance to the communities' lake nature walk, which is enjoyed by both children and adults. unfortunately, children of all ages enjoy and utilize this means of ingress and egress for fishing, small boating, playing and various activities. i find this outrageous, irresponsible and more importantly dangerous to the children of the community. although, the recent fence panel removal did not totally conceal the current condition, children notice the change and focus curiosity on all changes. it is obvious the only motivation is of personal monetary gain. removing a newer code compliant a/c system and placing with an "old", over 12 year old, 10 seer condenser not connected, and" strictly for presentation purpose only". further, it is unknown if the existing 240 volt, 40 to 70 amp electrical circuit has been turned off and locked out. as stated previously indicated, do to disregard for lifer safety and simply personal gain as stated previously, should be a criminally processed with the local criminal judicial system. immediate safety measures are required and expected. additionally, the older model 10 seer compressor recently set unit, copper line-set is not reconnected, sealed in any fashion and or may contain and release residual hcfc-22. my concerns are as follows waa a permit obtained for a/c change out? was the freon recovered per the epa? is a electrical contractor certified to remove a air conditioning system? did an a/c contractor permit this project? is the existing electrical properly sized / breaker installed for this unit? does this unit meet or exceed the current wind load requirements? does the existing unit meet the current florida energy code? is a three ton unit proper size for this residence? was an air handler re-installed / and meet the current florida mechanical code? is a heat trip installed / or is this a heat pump, which meet the minimum requirement florida mechanical code? what is the minimum seer rating 13 seer rating required for change out a/c systems? in my opinion and after your review of the owners conduct and /or the electrical contractor conduct the minimum requirements of federal, state of florida and local issued regulations and more specifically, united states, environmental protection agency epa, section 608 of the clean air act, has clearly not met and is in violation of the above referenced federal, state and local requirements. as you are aware, recovering and reclaiming refrigerant is a environmental requirement and is required particularly for hcfc-22 monochlorodifluoromethane, class ii ozone, depleting substances - cas number: 75-45-6 in 2010 and beyond. the epa re-claimer certification program ensures that epa-certified refrigerant re-claimers are required to comply with federal regulations, reducing emissions of ozone-depleting substances. epa has established that refrigerant that has been recovered and/or recycled can be returned to the "same system" or "other systems owned by the same person". however, if used refrigerant changes ownership, it must be reclaimed by an epa-certified refrigerant re-claimer. please provide evidence the above requirement have been met. should you need any photos are additional information, please feel free to contact me. fyi- ms janice watkins currently resides at: 3449 norland ct., holiday, fl 34691 also- the front entrance door has been replaced - only door / note frame?
