Description: Per letter of august 5, 2005, construction of the public storm drain is proceeding at kohl's risk. dedication of public easement or right of way for the storm drain and approval of the final plans by the city engineer are required prior to acceptance of the storm drain as a facility for public use. adequate drainage must be provided for any flows from the existing storm drain pipe through the site to the downstream drainage system while the new storm drain pipe is being constructed. active flow through the new storm drain pipe shall not be allowed until the new storm drain pipe and structures are complete, grouted and cured. after the existing drainage facility is removed for construction of the new storm drain, work shall proceed without interruption until the new drainage system is completed per city standards and approved plans and approved for use. all public improvements required through the building permit process must be completed prior to occupancy. occupancy may be allowed with some of the public improvements incomplete if the city engineeer determines that public safety issues have been adequately addressed and if kohl's has provided cash security to guarantee completion of the remaining public improvements. the amount of cash security required would be based on the construction cost of the outstanding public improvements plus costs that may be incurred by the city if it becomes necessary to administer the contruction project. upon satisfactory completion of the outstanding public improvements by kohl's the full amount of the cash security would be released.
