Description: 05/26/09: received a complaint from a concerned citizen regarding a pool violation. specifically a electrical cord running from pool equipment to house no protection for said address. i conducted a investigation and found the following. a pool above ground was erected without a building permit. this pool has been in existance for five plus years. i visited said address and was able to visually see the pool and determined that there are some building code violations under current adopted building code standards. reviewed the records and found no permits for a pool or other. i have concluded that though the pool is in violation of current building code standards it was constructed over 5 years ago from this entry date thus this issue is outside the statute of limitations rules that being 2.5 years as has been the policy at olathe. if the property owner at any point of time chooses to get a permit the pool will have to be brought up to current building code standards or if it is de-constructed and re-constructed it then will require a building permit. case closed.
