Description: Applicant requests approval of --- above ground: electrical distribution equipment & building mounted egress stairs; underground water meter & related piping. encroaching in the public right-of-way at 1508 grand. july 2 2009. great northern properties llp 1130 38th ave. ste. b greeley co. 80634. re: 1508 grand encroachment permit number cpoe 200911005 (revised 11/25/08). dear: great northern properties llp. please be advised that your application for encroachment permit on behalf of great northern properties llp is hereby approved subject to the following terms and conditions: 1. that permission is hereby given to great northern properties llp as owner and permittee for above ground: electrical distribution equipment & building mounted egress stairs; underground water meter & related piping. encroaching in the public right-of-way at 1508 grand as shown on drawings known as "exhibit a." 2. that all materials design and methods of construction shall be in accordance with all applicable codes and shall be subject to the approval of the director of city planning & development when final plans are submitted for a building permit. 3. that to hold the city harmless from claims for bodily injury and for property damage arising out of the construction the permittee shall keep in force a policy of liability insurance in an amount not less than that required by the kansas city building & rehabilitation code (kcbrc) chapter 18 code of ordinances. in the event the insurance requirements of the kcbrc are modified during the life of the construction the insurance provided by the permittee shall be revised to conform to the modified kcbrc standard. 4. that the permission given shall be construed as a permit and not a grant and may be revoked by the city at its discretion; upon revocation the permittee or the owner of the property at the time of the revocation shall cause the removal of the construction and the restoration of the area without expense to the city. 5. the installation has been approved by the municipal art commission. 6. that in consideration of the usefulness to owner and reflecting a fair assessment of the value of the right of way the sums of $98.84 has been paid in the nature of a license payment to the city for the privilege of using the public right of way for this purpose. this license must be renewed annually at a cost of $98.84 per year. this encroachment permit approval is as authorized by section 3201 of the kcbrc. please feel free to contact me if you have any further questions. sincerely. jerry windsor for sy noorbakhsh plans management branch.
