Description: 19 dec 08 -received a phone call from ms. adams who is living in the terrace level of the home at 5395 derby chase. the living space is not supplied with heat through the central heating system and the bedroom does not have a window or secondary egress. heat is supplied by space heaters. her question and complaint concerns inadequate heat. access to the upstairs portion of the house is blocked. this home is zoned cup. the property owners are mikhail skomorokhov and julie kathleen stevenson. she does not want to cause problems with the homeowner. she stated her lease is up on 31 jan 09. she does not want me to contact the homeowners at this time. i informed her of code requirements and made her aware of several safety concerns. she did not want to provide the address. 30 dec 08 - met ms adams at the property at 1300. she invited me inside and i photographed the bedroom, kitchen, interior stairwell, and exterior entry. ms adams states the door to the upstairs is locked. i did not verify this. the locked door creates a duplex or sub-divided home and is not allowed in this zoning. the area being used as the sleeping area does not have a secondary means of escape. ms. adams states she is not supplied with adequate heat. i explained the area must maintain 68 degrees f october to april per current property maintenance codes. she did not want me to speak to the homeowner until she had a chance to decide what she would do. 31 dec 08 - spoke to paul ivey, city building official, about ms. adams situation. if she is concerned about finding a place to live we should offer her the opportunity to let her lease expire in 30 days and find a new home before approaching the property owner. if she wants action immediately we will contact the property owner. any financial consequences as pertaining to deposits etc. are a civil matter between her and the property owner. 8 jan 09 - i spoke to ms. adams again about the situation where she lives to determine how she wants to proceed. she stated she wants to wait until he lease expires at the end of the month before moving out. 12 jan 09 - ms. adams left a voice mail stating the homeowner has removed the barrier to the upstairs portion of the dwelling thus bringing the property into zoning compliance. 15 jan 09 - ms. adams informed me she would be moving out of the dwelling on 31 jan 09. 21 jan 09 - met ms. adams at the premises, explained what she could do to remain living in the dwelling. the sleeping space would need to be in an area with a window, the door to the upstairs portion of the structure would need to remain unlocked to allow unobstructed access, and there must be an approved method to provide required heat to the living space. 31 jan 09 - ms adams moved out of the space. 5 feb 09 - spoke to julie stevenson, the homeowner of 5395 derby chase and explained that she can not subdivide her house and that any designated sleeping area must have window access to the exterior. 9 feb 09 - followed up with the homeowner about what was required for her to use the terrace level space for a roommate situation. she requested a statement that the temperature was adequate in the living area of her basement. i explained that i did not take a temperature reading and could not provide that documentation. 16 feb 09 - i again spoke to ms. stevenson about the requirements for living areas. a bedroom, by code, must have a window and can not use a window in a room adjacent to the bedroom, such as a closet or bathroom.
