Description: Description of complaint: homeowner has gutter pointing down into my property causing erosion and damage, in addition to this holes have been cut into the fence to force water away from his property and onto mine which is prohibited by hillsborough county ordinances: 4f storm water management technical manual http://www.hillsboroughcounty.org/documentcenter/view/3002 drainage patterns not to be changed to the detriment of neighboring properties notwithstanding the issuance of a natural resources permit by the county the act(s) of stockpiling material, grading, excavating, and other act(s) affecting drainage shall not change the surface drainage patterns to the detriment of neighboring properties or public rights-of-way. by common law, an upstream property owner has an easement over lands of a lower owner for surface waters to flow or escape from his land by natural ways and routes. an upper property owner may not, without liability, change the point of discharge of surface waters, nor concentrate them in ditches, nor divert in one direction waters which would have escaped in another direction, nor discharge them at a higher velocity, nor add to their pollution and cause a downstream property adverse impact. likewise, the lower owner may not, without liability, obstruct natural flow of surface waters onto his land, either by excluding it or causing backwater on his neighbor. these criteria also apply to changes in seepage slope and/or phreatic surface conditions. in disputes between private property owners, it is the right of the injured private party to seek an injunction because of a private nuisance created when the drainage was altered. the neighbor at 9416 bluebird drive has altered the landscape to ensure that the water flow goes into my yard in 3 separate areas and i have photos to prove this. i have spoken to the owner and asked that he point the gutter in the back yard away from my property and requested that he gutter the front and create a french drain or literately do anything to correct the issue and he has flatly refused causing damage to my property and landscape. in addition to this the home has peeling paint and mold growing on the backyard patio that he refuses to address despite complaints to our home owners association. his trees are growing over our roof causing us to have issues maintaining our flower beds and causing the roots to lift and crack our concrete curbing, this also had been ignored by the owner. i have attempted at my expense and time to fix these issues but nothing has worked due to the immense amount of water funneled on to my property by the neighbor. i need the drainage issues to be addressed so that's why i'm contacting code enforcement. complainant name: jay & maria blotner phone: 813-728-8665 email me a confirmation copy of this complaint: yes for an email copy of input, please enter email here: marias treasure [email protected]
